Lindsay Lohan’s probation has been revoked.. so why isn’t she in jail?

Lindsay Lohan’s lawyer, Shawn Holley, had to appear in court on her behalf yesterday to face the judge about just a few of her client’s charges.

Lindsay was charged with three crimes from her wreck over the summer, including lying to the police, and the judge revoked her probation.

But for some reason, she’s not heading to the slammer yet. Doesn’t a violation usually land you right in jail? I’m not sure, I’m not as familiar with the legal system as Lilo is, but I thought that’s how it worked. But no, she’s free and was probably littering the 12-12-12 concert with her presence.

There has been a court hearing set for January 15th so if Lindsay can manage to stay out of trouble for a few weeks, she will actually get to spend the holidays at home or a club or backstage at The Wanted concert or whatever.

We told you yesterday that Lindsay’s judge is pretty lenient and she opts for counseling over jail. Well the two different cities involved in the case are torn about they want it to be handled.

The Santa Monica city attorney, which is where Lindsay was involved in the wreck, say that she could face 19 months in jail for those charges but they think she just deserves community service because she didn’t commit a big crime. But in L.A., where she’s on probation for that jewelry heist, the city attorney thinks she should get jail time for her violation. She could get 245 days in jail for the violation. They intend to ask the judge that she gets at least 200 days in jail.

And one more bad thing for Lindsay. Her storage unit is about to get auctioned off. Sounds like a  sad episode for Storage Wars but that show is fake and unfortunately, Lindsay’s money misfortunes are not.

She owes $16k on the storage unit and the locker can not be opened until the balance is paid in full. And the IRS froze her bank accounts since she owes them all this money, so she doesn’t have a way to pay it off.

She’s begging her family for the money. But if she doesn’t come up with a fat check by the end of the month, her storage filled with designer clothes, family heirlooms and possibly embarrassing items will be auctioned off.
