Lindsay Lohan’s not in trouble yet… but the judge is not happy with her either.

Lindsay decided her own rehab fate and made a last minute switch to the rehab of her choice. She was supposed to go to Seafield Center in Westhampton Beach, NY but ditched that plan because they wouldn’t allow her to smoke cigarettes. Instead, she decided to go to Morningside Recovery in Newport Beach, California because it’s more her laid back kind of style.

Well her lawyer Mark Heller had to report to court on her behalf to prove that she went to rehab like she was told to do… And the judge was ticked that Lindsay took the law into her own hands. He said that rehab was not previously discussed but Lindsay could stay there while they investigated to make sure the rehab was suitable.

It’s not. It has several violations and their license was REVOKED by the California Department of Alcohol and Drug program. They lost their license after 20-year old patient Brandon Jacques died at the facility. He was seeking help for his bulimia and alcohol addiction and died after going into cardiac arrest while doing push ups.. The facility was not even licensed to treat people with eating disorders so everything ended up getting revoked.

All they can provide for Lindsay is a sober living environment but no treatment.

Geez this isn’t going to end. I know that Lindsay always gets away with trouble but this is ridiculous. Do something already. Revoke her probation, lock her up and end this Linsanity.

**UPDATE- While Mark Heller was in court telling the judge that Lindsay was safely tucked away in rehab, a photog snapped a picture of her shopping at a Fry’s in Fountain Valley, Cali. According to TMZ, she has yet to check into rehab (as of 2pm CT).

Today is the day that Lindsay Lohan is supposed to surrender to rehab.. And last night, she wasn’t only busy packing, she was trying to making some last minute deals.

She’s supposed to go to rehab at the Seafield Center in Westhampton Beach but decided that place wasn’t suitable because she couldn’t smoke cigarettes or take Adderall there.

She had her brother Michael Jr. call the prosecutors and beg them to allow her to go to rehab at The Lukens Institute in Southern California instead. We don’t know if her brother was able to work out another deal.. but why was he doing it instead of her lawyer Mark Heller?

Lindsay did post a picture last night of her in the middle of a packing frenzy. She wrote, “90 days and 270 looks”, which would mean she could wear three outfits a day. If she went to her original rehab destination, they only allow 7 outfits total so she would have to leave 263 outfits behind.

So Lindsay just took matters in her own hands. After missing her initial flight (insert fake shocked face here), she hopped on a private plane and flew from New York to California last night to go to her rehab of choice (which, according to TMZ, is Morningside Recovery in Newport Beach, CA, not the rehab her brother called about last night). That could be a probation violation if the court did not approve the rehab change. She can’t just call her own shots.

Mark Heller is scheduled to appear in court today with documentation to prove that Lindsay has entered in Seafield Center in NY. Guess we will see what happens.

Lindsay Lohan is supposed to enter into a rehab facility tomorrow so obviously she had to squeeze in some last minute clubbing!

Lindsay went to this NYC club called the Bitter End with a handful of friends. Supposedly she was just downing sodas all night and was only there to see her friends perform at this Jam Fest event.

Now Lindsay is supposed to check into a rehab tomorrow but that’s all up in the air. She reportedly hasn’t even chosen a facility yet and if she doesn’t check into one tomorrow, she will be in violation of her probation and could go to jail.. but we’ve heard that one before.

It’s also been rumored that Lindsay could earn a little cash while she’s confined to rehab by blogging about her experience there but a source says that’s not true. They said that Lindsay does want to start a blog to stay connected to “her fans” but it’d be a place for her to discuss her “love of fashion, music, art and her unique sense of style”, not her life lessons on the dangers of drugs and alcohol.

Lindsay’s usual fashion choices include thievery so I’m really not sure how she can stretch that out into a blog….

Lindsay Lohan isn’t quite ready to put down the vodka, the blow and give up the club life. She’s supposed to check into rehab in just a few days but she’s already trying to get out of it.

She has until May 2^nd (this Thursday) to enter a rehab that was chosen for her in New York. They had problems even finding a suitable rehab since there are no lockdown facilities. They finally decided on the Seafield Center at West Hampton beach, which is normally only a 28-day facility but they were going to allow Lindsay to stay for the full 90 because she needs all the help that she can get.

Well Lindsay’s trying to find ways to manipulate the system. Now she says that she’s changed her mind on that Hampton’s facility because now she wants to stay in California and they need time to find her a suitable rehab.

Another tactic to try to buy some more time is for her lawyer to have Lindsay ‘enroll’ in rehab but schedule her check-in date for a later time.

And someone else wants Lindsay to answer some questions in court but she’s managed to avoid that too.

This paparazzo named Grigor Baylan says that he was injured when Lindsay hit him with her car back in 2010 (not to be confused with that nanny she clipped in the same year or the pedestrian that she hit leaving the club last year). Well they have tried numerous times to depose Lindsay in the case and she has failed to appear every time, even after getting a $1,000 fine.

The last court date that she skipped out on for that was on April 8^th, which was the same day that she was photographed eating sushi and later appearing on the Late Show with David Letterman.
